III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the <br />inspection and the facts or evidence supporting the enforcement action. <br />The pre-existing ranch road, southeast of pond 2, will remain. The <br />diversion ditch above and to the southeast of pond 2 needs to be <br />put on to the bond release Map No. 1. This ditch is shown on <br />Exhibit K, in the permit application. This ditch was well vegetated <br />and showed no signs of erosion. <br />TOPSOIL STOCKPILE A <br />This area has been graded to AOC and is well vegetated. The grade <br />of the reclaimed area is compatible with the adjacent land. There <br />are no signs of erosion or instability. The twin collection ditches <br />that lie up gradient of topsoil stockpile A and run around the west <br />side of the pile, eventually leading to pond 3, need to be better <br />defined on the bond release Map No. 1. The ditches were well <br />vegetated and showed no signs of erosion. Within this ditch, on the <br />west side of the reclaimed topsoil stockpile A, is a seep. This <br />seep needs to be located on an appropriate map and, then, sampled <br />for water quality parameters. <br />TOPSOIL STOCKPILE B <br />The topsoil stockpile B area has been graded to AOC with the <br />reclaimed slope blending in with adjacent topography. There are no <br />signs of slope instability. The area is well vegetated, showing no <br />signs of erosion. The upland diversion ditch is well vegetated. <br />This area has been designated a small area exemption (SAE) through <br />TR-60. The designation relies on vegetative cover in order to <br />achieve compliance with sediment limitations. <br />SHOP/AAREHOIISE AREA <br />This area, as delineated on the bond release Map No. 1, does not <br />include pond 3. This pond has been approved as a permanent <br />impoundment. The operator has the option of applying for Phase 1 <br />bond release for pond 3. If this option is desired, then the bond <br />release application package will need to be amended. Map No. 1 will <br />need to show that pond 3 is included in the release request. In <br />addition, the release acreage total will need to be increased and <br />discussions in the bond release submittal will need to include the <br />pond. <br />3 <br />
