III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action <br />This was a complete inspection conducted by Kent Gorham of the Colorado Division of <br />Minerals and Geology (DMG). The weather on this day was clear and sunny. Ground <br />conditions were dry and access was good to all areas. <br />Availability of Records <br />The public copy of the mine records is kept at the office of Peak Protect Management (PPM). <br />The contact, address, and phone number for PPM is Ron Thompson, Peak Project <br />Management, 34115 County Road 20.8, Trinidad, CO 81082, 719-846-4975. The operator <br />provided a copy of a valid Liability insurance certificate to the inspector for the DMG copy of <br />the mine records. The certificate is now in compliance with Rule 2-03.9. All other records <br />were found in compliance as detailed on page 2a of this report <br />Hydrologic Balance <br />All ponds at the site held water due to <br />continued precipitation over the last <br />month. Pond 6 held water below the <br />lowest hole on the principle spillway riser <br />(see photo to right). The vegetation on <br />the pond embankment is becoming well <br />established. <br />Pond 5 was holding water to the lowest <br />hole on the primary riser, Pond 8 held <br />water also, but again below the lowest <br />discharge point. Pond 7A and 9A also <br />held water to about 1/3 capacity and were <br />not discharging. Pond 10 at the loadout <br />held a pool of water as is typical for this <br />pond. <br />.. <br />A.t~1~ <br />i <br />R <br />~. <br />~ ... . <br />•~ ~.~_, <br />y ~`~i ~'' <br />~ ^^ <br />Pond 9 was recently cleaned of <br />sediment. It also held some water well <br />below the discharge point. The water <br />was very clear. indicating no recent <br />runoff to this pond. The embankment <br />and disturbance associated with cleaning <br />of the pond has been reseeded and <br />mulched since the last inspection. (see <br />photo to right) <br />
