III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />Permanent Drainage Channels <br />Significant progress has been made with respect to permanent drainage channel <br />construction since the previous inspection. In the "A" Pit area, the entirety of 006 Gulch <br />and all of its tributary channels have been constructed and riprap appears to have been <br />installed where required, with the exception of one segment of the 006 channel below the <br />NE2 confluence, which may be steep enough to require riprap. 006-51 and 006-SE1 <br />channels had been completed prior to the previous inspection. In the "B" Pit area, the lower <br />steep segment of Channel 006-NE1 has not yet been completed, but under-liner had been <br />laid, riprap was on hand, and the plan was to place the riprap as soon as soils were frozen <br />sufficiently to allow safe equipment operation along the channel. The drainage channel <br />construction is to be completed by the end of 2004. <br />Backfill and Gradin <br />Backfilling and grading operations appear to be in compliance with the timeframe <br />requirements of the approved permit. <br />The "A" Pit highwall reduction slope that had slumped and was repaired earlier this fall has <br />now been topsoiled and seeded. There was no indication of renewed slumping or other <br />indications of instability. <br />Drilling was underway along the South Wadge Pit highwall near Stockpile VV to allow for <br />blasting of the highwall to facilitate reclamation cast blasting. <br />Topsoil and Revegetation <br />Topsoiling has been completed in the "B" Pit Area and most areas of the "A" Pit, with the <br />exception of approximately 20 acres of the lower "A" Pit, including portions of the South <br />Highwall, slopes along lower 006 Gulch, and the area where Pond 006 sediment was <br />spread to dry. Topsoil was being spread by D-6 dozer in these locations, and likely will be <br />completed this fall, with the exception of the sediment spreading area, which has not dried <br />sufficiently. Steep slope soil roughening and seeding has been completed in areas where <br />soil replacement has been completed, following closely behind topsoiling operations. <br />Re-grade spoil and soil sampling addressed in the previous report has not yet been <br />completed, due to problems with the contractor doing the sampling. The sampling is still <br />scheduled for this fall, and analyses are required to be included in the 2004 annual <br />reclamation report. <br />The fencing of the aspen establishment area located on the eastern ridgeline has been <br />completed.
