<br />(Page 21 <br /> <br />MINE ID ar OR PROSPECTING ID 1l M-81-229 <br />INSPECTION DATE 06/17/97 INSPECTOR'S INITIALS TDG <br />OBSERVATIONS <br />The purpose of this inspection was to field verity the information presented on an updated mine plan map that was provided to the <br />Division as part of a Succession of Operator approval from Corn Construction to Parkerson Construction. Observations made during <br />the inspection were also used along with the requirements of the approved mining and reclamation plan to recalculate the amount <br />of financial warranty that needs to be held for the operation. <br />GENERAL INSPECTION TOPICS: <br />A mine identification sign showing the permit number and containing a statement that a reclamation permit has been issued by the <br />Mined Land Reclamatin Board needs to be installed at the entrance to the site. Also, the full perimeter of the permitted area needs <br />to be delineated on the ground by installing a series of clearly visible perimeter markers. <br />The location of the proposed access/haul road into the site differs between the location shown on the maps approved in the original <br />permit application and the updated map provided with the Succession of Operator. In addition, the probable location of the proposed <br />road as discussed with Mr. Derrick during the inspection may follow yet a different route. Because the access/haul road is included <br />within the permitted/affected area, any changes to the location of the road from the specific location that was approved in the <br />original application must be done via an amendment to the approved permit. <br />The "previously mined area" delineated on the mine plan map appears to have been regraded and successfully revegetated. As such, <br />this area will not need to be bonded for unless the operator plans on redisturbing the area in the future. Please clarify. <br />No overburden or topsoil stockpiles were observed on site at the time of the inspection. This generates a concern as to whether <br />there will be sufficient quantities of suitable plant growth material available to successfully revegetate the affected area at the <br />conclusion of mining. The approved permit requires that 5"-10" of topsoil be respread over regraded areas during final reclamation. <br />As such, the permittee must demonstrate that sufficient quantities of suitable plant growth material are available on site to cover <br />all disturbed surfaces with a 5"-1 0" layer during' final reclamation, and that such quantities will be stockpiled on site and maintained <br />until used in reclamation. Any soil materials to be used for reclamation must be demonstrated to be suitable as a plant growth <br />medium and capable of supporting the approved postmining land use. <br />FINANCIAL WARRANTY RECALCULATION: <br />The Division has prepared and attached a reclamation cost estimate for the site. The total amount worked out to S50,032.00. This <br />amount represents the minimum amount of financial warranty that must be held by the Division to ensure successful reclamation <br />of the site by a 3rd party contractor in the event of permit revokation and bond forfeiture. Since the current bond amount being <br />held by the Division for this site is 517,500.OO,the permittee will need to provide an additional 532,532.OOin bond monies to the <br />Division within 60 days. <br />This operation was approved as a phased mining operation where mining and reclamation activities will be conducted within 5 to <br />10 acre phases. However, the information presented in the mining and reclamation plan portion of the approved permit application <br />is not clear as whether the access road, facilities and stockpile areas are included in the 10 acre disturbance limit. It is also not clear <br />as to whether the phasing will be done in such a manner that no more than 10 acres will be in an unreclaimed condition at any one <br />point in time. In order for the Division to base the bond calculations on a maximum 10 acre disturbance, the operator would have <br />to ensure that all portions of the permitted area outside the 10 acre disturbance limit are either undisturbed or completely and <br />successfully reclaimed. Please clarify.
