Residential development has extended further south since the <br /> original permit (based upon aerial photos) and may be affected by <br /> particle blowing off the deposit stockpiles, and unvegetated areas of <br /> the site, due to the northeast prevailing winds. The distance between <br /> the residential areas and the major disturbances of the Turnpike site <br /> should act to minimize such effects, however. <br /> 7. The Turnpike Pit operation may have disturbed unpermitted lands <br /> to the west of the permit area (not including private lands not owned by <br /> Flatiron Sand and Gravel Co. adjacent to residential sites) . <br /> B. The flood control berm on the proposed Deepe Farm Pit is not a <br /> permitted feature. <br /> B. The Mined Land Reclamation Act <br /> 1. Control of mosquitos is not specifically covered by the Mined <br /> Land Reclamation Act, nor has mosquito control been interpreted as an <br /> indirect concern of the Act. The Division will , however, cooperate <br /> with the concerned parties in resolving the matter. <br /> 2. Section 34-32-116(b) , CRS 1973. <br /> 3. Section 34-32-116(j) , CRS 1973. <br /> 4. Commitments Agreed to Informally at the Site by Mike Hart, for Flatiron <br /> Sand and Gravel Company <br /> A. The Following Commitments Pertain to the Turnpike Pit <br /> 1. The operator will contact and assist the Colorado Department of <br /> Health regarding mosquito control at the Turnpike site. <br /> 2. Where possible, standing water will be drained. <br /> 3. Deposit stockpiles will be reduced in height and steepness during <br /> regular removal of existing stockpiles. Future stockpiles will be <br /> placed and shaped in a manner that will reduce visual obstruction; reduce <br /> particle blowing; and improve public safety. <br /> Note: This agreement is voluntary cn the part of Flatiron. Sand and <br /> Gravel Co. , and may, in part, not be required under the Mined Land <br /> Reclamation Act. <br /> 4. The operator will topsoil and revegetate unvegetated areas at <br /> the Turnpike Pit. The operator should address where topsoil will be <br /> obtained. <br />
