Therefore, if it is the Operator's contention that the water being held on site is storm water
runoff, then this water must not be held on site for greater than 72 hours. If the Operator's
contends that the water being held on site is exposed ground water, then the Operator must
submit a Substitute Water Supply Plan to OSE. However, both issues may be resolved if the
Operator follows the original recommendation of the Division, that the azeas holding water be
filled with a minimum of two (2) feet of material above the highest ground water elevation.
Resolution of both of these issues, including photographic evidence of the staked permit
boundaries and fill of the water-holding areas (if that is the option chosen) must be received by
the Division by September 1, 2006.
If you have any questions, please do not hesitate to contact me at (303) 866-4179.
Sincerely,
l
eb G6 'ma
Environmental Protection Specialist
cc: Dick Wolfe, Division of Water Resources, Office of State Engineers
Mason King, Potential Succession Operator
Cazl Mount, DMG (via a-mail)
