Smith Pit #5, <br />Dear Mr. Champ: <br />Since the last inspection performed on June 28, 2006 the Operator has submitted a response to <br />the Division's required Corrective Actions. This response included explanations for the lack of <br />permit boundary mazkers and possible on site ground water exposure. These explanations, while <br />helpful, do not fully address the Division's concerns. <br />The County and Division's lack of a map illustrating the location of the pit and the approved <br />permit boundaries is due to the history of this permit. This particular pit was once part of an <br />older multi-pit permit. The V.F. Smith Pit #5 was reassigned an individual permit number in <br />December of 2002. Neither the Division nor the County had an accurate map of the site in its <br />possession when this pit was assigned its own permit number. <br />An accurate map of the permit azea is required. However, given the history of the pit and the <br />information gaps involved, the County has the ability to stake the boundaries as accurately as <br />possible within the following constraints: approved acreage is 9.9 acres; approved approximate <br />location is SW ''/e, SW ''/a, Section 31, T4SR49W. Once the pit is staked the Division must have a <br />map that cleazly depicts the location of the permit boundaries. This map shall include any and all <br />adjacent creeks, rivers, and roads. <br />It is the belief of this inspector that the water held on the permit area at the time of the inspection <br />was ground water. This opinion is the result of this inspector's ability to identify vegetation in <br />the azeas of concern that was indicative of riparian areas and/or areas exposed to water for a <br />substantial amount of time. The Office of the State Engineer's (OSE) requires "exposure of <br />ground water must not occur during or after mining operations." If ground water is exposed, then <br />a Substitute Water Supply Plan must be submitted to OSE and approved. Additionally, OSE <br />requires that "if storm water runoff is intercepted by this operation and is not diverted or <br />captured in priority, it must be released to the stream system within 72 hours. This may require a <br />dischazge permit from CDPHE-WQCD. Otherwise, the operator will need to make replacements <br />for evaporation."
