Delta Sand and Gravel Co• • Page 2 <br />Pit 3 - M-77-022 <br />3. The site is in the process of being cleaned up and we stopped the practice the day after the <br />inspection, when we found out it was not allowed in the permit. We will be finished by <br />8-15-97. <br />4. We do not feel it is necessary to submit a revision to change the approved reclamation <br />plan. As for the "existing pond" being gone, nature reclaimed it in 1983 when Minnesota <br />Creek flooded the area. In the original Mining Plan text we built the flexibility into the <br />permit to deal with Stage 3 and the new lake area. On pages 6, and 7 we specifically <br />qualify the uses of Stage 3. On page 7, in the last sentence of first the paragraph, we <br />noted that Stage 3 would not be mined "...unless it becomes absolutely necessary." This <br />means that we would only have to construct a lake in that area IF it was mined. This <br />contingency gave us the flexibility to extend the offsite lake if the need for material was <br />necessary. Vv'e did not guarantee a lak;; would exist nor did we guarantee the "existing <br />pond" would remain. <br />In 1983 when the creek flooded and filled the "existing pond", our plan to have a lake <br />changed as allowed in the permit. We did not intend this to happen but frankly it was to <br />our advantage and since we are not permitted to disturb the area, we left it as nature <br />reclaimed it. The "existing lake area has been used since that time by the ready-mix side <br />of our operation to store raw material needed to supplement what is mined in this pit. <br />Since 1984 the material on this area has been delivered to the site from other mining <br />operation we have in Delta county. This is an industrial use that is part of the ready-mix <br />operation south of Minnesota Creek and will continue after the mine has been reclaimed. <br />In the past, the "existing pond" area was used to store equipment destined for the coal <br />mines in the surround area. We do not believe we have to revise the Mining or <br />Reclamation plans to address a pond that does not exist nor do we need to include the area <br />in the permit since it is part of an off site industrial use. I have included excerpt pages <br />from our permit highlighting where Stage 3 and the end use were discussed.
