III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations <br />made during the inspection. Comments also describe any enforcement actions taken during <br />the inspection and the facts or evidence supporting the enforcement action. <br />Coal Stockpiles <br />Coal stockpiles have been completely depleted due to the longwall being shut <br />down. The ditches around the development coal waste pile were clear and <br />functioning with the exception mentioned below. The wash plant was down <br />during this inspection. <br />The lower slopes of the Development Coal Waste Pile were vegetated. Culvert <br />C37 at the north end of the waste pile was clear and functioning. Pond 004a <br />contained some runoff from recent rainfall. Ditches D3, D10, D13 were clear and <br />functioning. Culverts C-6, C-7, C-8, C-9 were all clear and functioning. <br />West Portal <br />No concerns were noted in the west portal area. All ditches and culverts were <br />clear and functioning. <br />East Portal <br />Culvert C-2 was clear within the permit area. The following ditches were clear <br />and functioning; D-1, D-7, D-9, D-6A, D-8, D-6, D-5, D-18, D-17A, D-17B, D-17, <br />D-16, D-20, D-25, D-24, D-23, D-23A, D-22, D-32, D-15, D-12, D-11 and D-19. <br />The culverts in this area were functioning. Containment areas #1, #3, #4, #5 were <br />functioning. Anew concrete containment is being constructed for the sulfuric acid <br />tank. This is located just south of the thickener tank. The containment will also <br />protect the filling hose from leaks and breakage. The polyethylene antifreeze <br />tank adjacent to the silo will be placed in the old concrete containment as soon as <br />it is cleaned out. The culverts and ditched next to the coal silo required <br />
