<br />III. Comments - Compliance <br />Below are particular issues with regard to any of the compliance items. <br />Enforcement actions resulting from failure to comply with the Act, Rules <br />and Reyulations, and the permit also are identified below. <br />Roads (4.03) <br />Western Associated Coal's equipment had recently regraded the <br />roadways and the coal storage area. <br />Hydrologic Balance (4.05) <br />1. We toured the underground mine workings of the Red Canyon Mine <br />with Mr. Reschke. We determined that the ground water hydrology and <br />subsidence phenomena evidenced within the Red Canyon workings are in <br />conformance with the permit application descriptions and projections. <br />2. Ground water is being drained from old pre-law Red Canyon mine <br />workings into the active Red Canyon Mine, in order to prevent mechanical <br />and hydrological problems within the active mine workings. The drainage <br />` quality and quantity are being monitored. <br />3. The east diversion ditch had been effectively cleaned of weeds <br />and brush. <br />Excess Saoil and Development Waste (4.09 <br />Western Associated Coal's equipment was actively transporting <br />stockpiled waste from the designated storage area to the approved <br />permanent waste pile. The waste was being placed by truck and spread and <br />compacted by a mechanical compactor. <br />Uther: Subsidence (4.20) <br />The Operator proposes to backfill and reyrade several areas <br />within the permitted area which have recently developed collapse pits <br />above shallow (less than 30 feet deep) pre-law underground coal mine <br />workings. Some minor surface disturbance will result, but should be <br />minimal. The Operator will be responsible for the timely reclamation of <br />any surface disturbance which does result. The Uperator is commended for <br />undertaking the backfilling and grading. <br />t~ <br />
