• (Page 21 • <br />MINE ID # OR PROSPECTING ID # <br />INSPECTION DATE 5/9/96 <br />M$0-146 <br />INSPECTOR'S INITIALS WHE <br />This complete inspection was conducted by Wally Erickson from the DMG field office in Durango, 1474 Main Avenue, Room 207, <br />Durango, CO 81301-5182,phone (970) 247-5062. Mr. John Gilliland, C & J Gravel Products, accompanied the OMG inspector <br />during the inspection. The inspection occurred in response to a request submitted by the operator for an on-site meeting. The <br />operation is located approximately 6 miles SE of Durango, on Colorado Highway 160. The Regular 112 permit is approved for 24 <br />acres affected area. DMG holds financial warranty in the amount of 534,004.00. Mining operations were active during the time <br />of this inspection. <br />Mine identification sign was posted at the access road adjacent to Highway 160, West perimeter of the affected area was marked <br />by an abandoned barbed wire fence. Fencing also delineated a portion of the south perimeter. Perimeter markers were not observed <br />for the north boundary. East side perimeter was not inspected. Rule 3.1.12121 states that the boundaries of the effected area will <br />be marked by monuments or other markers that are clearly visible end adequate to delineate such boundaries. Rule 3.1.12121141 <br />defines "affected area" as the area proposed to be disturbed by mining operations for which a financial warranty and performance <br />warranty have been posted. Please ensure affected area perimeter markers are posted and maintained in accordance with 3.1.12121. <br />An underground natural gas pipeline is located along the north boundary of the affected area, yellow pipeline markers identified the <br />pipeline location. One pipeline marker had been crushed by vehicle traffic, DMG inspector could not determine whether pipeline <br />marker had been damaged by mine vehicles or by vehicles not associated with the mining operation. The pipeline and pipeline <br />access road appeared to be located within 200' of the affected area but is not identified on the Pre-mining and Mining Plan Maps, <br />as required by Rule 6.4.314) end Igl. Topsoil and overburden stockpiles were located inclose proximity to the pipeline location but <br />did not appear to overlay the pipeline. Mining activities did not appear to have adversely affected the stability of the pipeline or <br />access road; however, the permit does not contain a compensation for damage agreement or appropriate engineering evaluation that <br />demonstrates that the pipeline will not be damaged by mining activities, as required by Rule 6,4.19. <br />6.4.19 Where the mining operation will adversely affect the stability of any significant, valuable or permanent man-made structure <br />located within 200' of affected land, the applicant may either: <br />la) provide a notarized agreement between the applicant and the personlsl having an interest in the structure, that the applicant <br />is to provide compensation for any damage to the structure; or <br />(b) where such an agreement can not be reached, the applicant shall provide an appropriate engineering evaluation that <br />demonstrates that such structure shall not be damaged by activities occurring at the mining operation. <br />The operator stated that the pipeline was not identified on the Pre-mining and Mining Plan Maps because the pipeline had been <br />installed after permit issuance. Please submit a revised Mining Plan Map, which identifies the pipeline and pipeline access road, in <br />accordance with Rules 6.4.314) and Igl. Please submit a notarized agreement for damage compensation or appropriate engineering <br />evaluation that demonstrates that the pipeline will not be damaged by mining activities, in accordance with Rule 6.4.19. Revised <br />Mining Plen Map and documents required by 6.4,19, may be submitted through the Technical Revision or Amendment processes <br />described in Rules 1.1171, 1.11491.1.9, 1.10 and Sections 34-32.5-125(11(al(VI) and IVIp of the Colorado Land Reclamation Act <br />for the Extraction of Construction Materials, 34-32.5-101, et seq, C.R.S., 1995, as amended. <br />Crushing and asphalt plants were operating. Colorado Dept. of Transportation trucks were hauling material off-site. Permit needs <br />to be revised to describe the asphalt plant. Archaeological exploration sites were located along the west perimeter of the affected <br />area.
