III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken durng the inspection <br />and the facts or evidence supporting the enforcement action <br />This was a complete inspection conducted by Kent Gorham of the Colorado Division of <br />Minerals and Geology (DMG) Henry Austin of the Office of Surface Mining also <br />accompanied me on the inspection as part of the OSM Oversight inspection plan for 2006. <br />George Patterson represented Energy Fuels Coal Company (EFCC) on the inspection This <br />mine has closed and reclamation of most areas is complete. Temperatures were warm and <br />ground conditions were dry. <br />Availability of Records <br />The public copy of the mine records is kept at the Energy Fuels Coal Company office in <br />Florence. All records were found current and in compliance. Ground water sampling for <br />2006 will take place this month as required by the approved plan. The required liability <br />insurance is in effect till October 2006. Pond and refuse pile inspections were on file for the <br />first quarter of 2006. More details regarding the records inspection can be found on page 2a <br />of this report. <br />Signs and Markers <br />Mine identification <br />signs as regwred <br />by Rule 4 02 were <br />found at the mine <br />sde and the former <br />coal loadout.
