t <br />~` I• <br />Ill. COMMENTS - C04t1PL{ANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the <br />inspection and the facts or evidence supporting the enforcement action. <br />This was a complete inspection, conducted by Joe Dudash of the Colorado Division of <br />Minerals and Geology. Basil Bear represented the operator. <br />Facilities <br />The operator has removed the metal structures from the west portal mine, in preparation <br />for reclamation activities, which will begin in one to two weeks. <br />Many of the metal structures at the main mine site will also be removed. <br />During the inspection, coal haul trucks were unloading at the train ]oadout and a train was <br />being loaded. There were no problems with fugitive dust. <br />A large amount of coal has been stockpiled at the highway coal stockpile area. Snow <br />fencing has been placed along the top of the pile to control fugitive dust. During the <br />inspection, there was no problem with fugitive dust. However, the south side of the coal <br />stockpile is very steep and is falling away. This is very close to undermining the fencing. <br />The steep slope is also a possible safety hazard. The steep slope should be lessened and <br />"no trespassing" signs might be put up. <br />Topsoil Stockpiles <br />There were no erosional"gullies at any of the topsoil stockpiles. Vegetation on [he topsoil <br />stockpiles was moderate. All of [he topsoil stockpiles had topsoil signs. <br />Hydrolow <br />The only pond [hat httd any water in it was the west portal pond, which was 6 feet below <br />discharge. The ponds at the ROM pile and the train loadout were dry. The other ponds, <br />namely ponds 1 through 4 and the highway coal stockpile pond, were we[, but had no <br />standing water. Pond embankments and bin walls were stable. Spillways were functional. <br />The culverts, collecti~~n ditches and diversion ditches were functional around the mine <br />site. However, the ditch behind the former wazehouse at the main mine site will need <br />some maintenance soon because some rocks and din has fallen into the ditch. For now, <br />the ditch is functional. <br />
