<br />III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />General Comments <br />This was a complete quarterly inspection of the mine site and office records, conducted by Dan Mathews of the <br />DMG Grand Junction Field Office. Field inspection was conducted on afternoon of March 28, and all day, March <br />29; office records were checked on the morning of March 30. All disturbed areas were inspected. Tonya <br />Hammond, SCC owner representative, was present during the inspection on the morning of March 29, and <br />during the records check at J.E. Stover & Associates office on March 30. <br />Weather was cloudy and cool on March 28; ground conditions relatively dry in most areas. Weather was colder <br />and windy on March 29, with rain showers and mixed rain/snow flurries in the afternoon. The precipitation was <br />sufficient to generate some flow in roadside ditches during the inspection. <br />Availability of Records <br />Required records were on file and up-to-date through the 4th Qtr., 2005. P.E. certification of the reconstructed <br />Pond 11 embankment (with spillway eliminated) was completed during the quarter and placed on file. <br />A problem had been noted in the 4`" Qtr. 2005 CRDA-1 piezometer monitoring report; a number of the 300 and <br />400 series piezometers exhibited "constrictions", and accurate depth to water checks were not obtained for <br />several of the piezometers. Ms. Hammond reported that the problem was not encountered during the 1~` Qtr. <br />2006 monitoring, and accurate measurements were obtained. <br />Roads <br />The condition of permitted roads and associated structures was in general satisfactory. Culvert maintenance <br />is warranted in a couple locations; the culvert at junction of CRDA•1 temporary road and Xcel ash haul <br />road {inlet obstructed by tumble weeds) and the culvert at the light use road crossing of the RSRDA <br />upper diversion ditch (sediment deposition at outlet). <br />Hvdrolooic Balance <br />Drainage and sediment control structures were in general properly maintained and functional. The only <br />exception was that several of the silt fence installations require maintenance. Several of the silt fence <br />segments at the South Fan, 2 West Portals and "B" Fan site were wind damaged and need to be <br />replaced. One of the installations at the South Fan is on sandstone bedrock; use of straw bales to <br />support the silt fence installation and "anchor" the fabric in locations with insufficient soil for trenching <br />is recommended. <br />The condition of permanent ephemeral stream channels on the reclaimed areas appeared unchanged from the <br />condition described in recent inspections. <br />Sediment Pond 8 and Pond 1 &2 contained shallow puddles of water; other sediment ponds and SAE sumps <br />were dry. <br />Diversion and collection ditches and berms were properly maintained and functional. <br />There was small flow out of both portal openings at the South Portal Area, which was properly draining into Pond <br />8 via the portal bench drain and buried pipe. <br />Minewater Discharge Site 016 was discharging clear flow, approximately 290 gpm. <br />3 <br />
