Prior to the bonding negotiations, the amendment application submitted to the Division <br />last year was in the initial stages of preparation. During the bonding negotiations, which <br />lasted several months, no progress was made on the amendment because so much effort was <br />being expended in responding to Mr. Berhan Keffelew's concerns expressed in his inspection <br />report. It was also possible that the results of the bonding negotiations could affect the content <br />of the amendment. Immediately after the bonding situation was settled, work proceeded on <br />the amendment. <br />PROPOSED SOLU7TON: <br />Transit Mix Concrete proposes the following: <br />1. No further mining will occur in the area of the collapse until such time as the <br />amendment is approved. <br />2. If the amendment is not approved by the end of 1993 then the Division and Transit <br />Mix will discuss whether further remedial action is to be taken or, if the amendment is near <br />approval, whether a further delay in taking action is appropriate. <br />3. The affected land will be monitored during this period. Inspections will occur at <br />intervals of not less than four weeks. During each inspection photographs will be taken from <br />the same locations as the photographs included in this report. As each new set of photographs <br />are taken, copies (in the form of prints) will be immediately provided the Division as a record <br />of any changes that might occur in the extent of the disturbance. Each photograph will be <br />labeled as to date and time. <br />The primary reason the special use permit application has not been completed and <br />submitted to El Paso County so the Division can proceed with processing the Reclamation <br />Permit amendment, is because of the heavy involvement in the intensive and on going <br />negotiations with the Joint Colorado Springs/EI Paso County Mining Reclamation Advisory <br />Committee (MRAC) over enhanced reclamation plans on Castle Concrete's limestone quarries. <br />Castle Concrete and Transit Mix are sister companies, both of which are owned by Continental <br />Materials.
