Mr. Douglas Conger, Nielsons <br />Inc., accompanied the DMG inspector through out this inspection. The original permit was approved 6/17/77 to continue extraction <br />of sand and gravel from apre-existing disturbance, maximum affected area was approved at 19 acres. On 9/28/92, DMG approved <br />TR-01, addressing an adjustment in permit acreage, maximum affected area was restated to be 18.3 acres. As part of TR-01, DMG <br />approved Exhibit H, Estimated Cost of Reclamation. Exhibit H contained a recalculated cost for reclamation and stated the cost <br />to be 529,229. DMG receipt records indicate that the amount of financial warranty has NOT been increased to the approved <br />529,229, as required by TR-01. DMG holds financial warranty in the form of corporate surety, bond no. OS 19 42, with National <br />Union Fire Insurance Company of Pittsburgh, PA, in the amount of S10,300. <br />Mrne identification sign and affected area perimeter markers were observed as per Rule 3.1.12. Additional perimeter markers will <br />be required as the operation expands west, into the pasture field. <br />The affected area appeared to encompass 5 - 7 acres. Approximately 500 lineal feet of 40 foot tall highwall was observed. Existing <br />highwalls appeared stable, no evidence of sloughing was observed on the face, no surface cracks were observed along the crest <br />of the highwall. A barbed wire fence had been constructed along the crest of the highwall as a safety barrier. The fence needs <br />maintenance to ensure that it continues to function as intended, <br />Two upland drainage channels discharge drainage from the undisturbed uplands into the pit. The ephemeral drainage channels were <br />approximately 10 feet wide and 2 feet deep, both were well vegetated and appeared stable. Minor erosion was noted where the <br />ephemeral channels outlet at the crest of the highwall. Drainage is contained within the pit, no evidence of offsite erosion or <br />sedimentation was observed. <br />The operator needs to perform weed control measures on the affected areas of the operation. Rule 3.1.1016) states that weed <br />contro! shall be employed for all prohibited noxious weed species, and whenever invasion of a reclaimed area by other weed species <br />seriously threatens the continued development of the desired vegetation. Weed control methods shall also be used whenever the <br />inhabitation of the reclaimed area by weeds threatens further spread of serious weed pests to nearby areas. A list of noxious end <br />problem weeds and control techniques for these species can be obtained from the County Extension Service, the County Weed <br />Control District Office, or the local office of the Soil Conservation Service. <br />Seven 55-gallon drums were located on site, several drums contained fluids. The drums appeared intact, no evidence or rupture <br />or leakage was observed. All fuels, lubricants, and chemicals need to be stored in a controlled manner, at a designated location, <br />with adequate spill prevention and spill containment controls. Spill containment controls typically include measures such as <br />construction of a containment berm surrounding fuel tanks or fluid storage area. Berm surrounding the fluid storage area should <br />enclose sufficient area to ensure containment of volume equivalent to combined drum or tank capacity. Containment areas should <br />be lined with an impermeable liner to ensure spilt fuel or fluids not escape and degrade quality of ground and surface waters (Rules <br />3.1.6 and 3.1.71. It should be noted the financial warranty for the operation will be recalculated, including costs for disposal of <br />discarded fluids, should they remain on site. <br />No equipment was located at the mine site. General observations of the site suggest that the site has been dormant.
