A field inspection was made as a follow-up to the Division's previous <br />inspection on May 09, 2006 where a number of problems and a possible violation <br />were noted. The purpose of the inspection was to verify the extent of corrective <br />actions completed; the status of these corrective actions to be presented at the <br />July 12, 2006 Board Hearing. The Division has scheduled a Hearing at the July <br />12, 2006 Board Meeting to consider a possible notice of violation, cease & desist <br />order, civil penalties, and corrective actions for failure to protect areas <br />outside the affected lands from slides or other damage. As noted in the May 9, <br />2006 inspection report, the operator had created damage on an adjacent <br />landowner's (Tony Finley's) property, immediately east of Colorado Highway 85 and <br />near the Porter seepage ditch. <br />2. Present during the inspection were Dave Jordan and Kevin Moore of Lafarge and <br />Dana Ortiz of Civil Resources, LLC. Digital photographs of the area of concern <br />were taken and are attached to this report. <br />3. The site inspection confirmed that the operator has successfully completed <br />corrective actions 1 & 2 as listed on page 4 of the Division's May 9, 2006 <br />inspection report. The operator has done an exemplary job of removing all <br />disturbance on Tony Finley's property, establishing a 3-strand boundary fence <br />identifying the property boundary (and permit boundary) between the Finley and SW <br />TKO property, and stabilizing the previous gully erosion on the north side of the <br />drainage channel east of Highway 85 and near the Porter seepage ditch. <br />Therefore, Corrective Actions 1 & 2 have been resolved to the Division's <br />satisfaction and are now abated. <br />4. The operator has re-established the permit boundary for the Lupton Lakes <br />Resource on the east side of Colorado Highway 85 and near the Porter seepage <br />ditch. The permit boundary encompassing the Porter seepage ditch and Ogilvie <br />seepage ditch on the west side of Highway 85 have not been established. It is <br />the Division's understanding that there is a civil matter pending between SW TKO <br />and Andrew Chavers regarding this issue.
