III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />structure, and the water tank and pump house. The Conveyor Transfer structure, stacker, and associated <br />conveyor structures had been dismantled and removed. There was a pile of scrap metal at the upper end of <br />the rail loop approximately 150' long by 30 feet wide by 8 feet high, that Tonya Hammond indicated would <br />be shipped out by rail. <br />Convevor Corridor <br />Transfer building #4 at the Rail Loop had been removed, along with all conveyor structure including <br />footers between the rail loop and the truck scales. The conveyor culvert a[ [he upper end of the rail loop <br />had been cut off at both ends, and apparently filled in, covered over and rough graded. There had been <br />some rough grading along the condor in the section between the rail loop and the scales, but further <br />grading will be necessary in several sections to blend the fill into the adjacent terrain. The truck scale is <br />still intact. <br />The exposed conveyor culvert segment that had extended across Coal Creek near the scales had been <br />completely removed. Sediment controlberms had been re-built along both sides of Coal Creek. On the <br />south side of the creek, the conveyor culvert section that had extended from Transfer #3 beneath the county <br />road had been cut off where it emerged from beneath the road fill on both sides, and apparently filled in, <br />covered over, and rough graded on both ends. Transfer building #3 had been removed. <br />Removal of remaining footers between Transfer #2 and Transfer #3 location was in progress during the <br />inspection. Transfer #2 structure and the river span tube and support structures remain intact. <br />South Portal Area and V icinity <br />Minewater discharge sites 002 and 001 were both dischazging clear water <br />The South Portals upper bench appeared largely unchanged since the previous site inspection. Warehouse, <br />shop and office facilities remain intact. The portals have been sealed approximately 100 feetinby the <br />openings, which have been temporarily secured to prevent entry by unauthorized persons. The openings <br />have not yet been backfilled. <br />At the material storage area on top of the RSRDA refuse area there was one pile of scrap metal <br />approximately 50' by 30' by IS' high, and one pile of mostly wood scrap approximately the same <br />dimensions. At one end ojthe wood scrap pile, !here were a number ojoily rags and used oi! filters, <br />several empty grease and oil containers and one capped 5 gal. plastic container, approximately %: ju!! of <br />fluid (apparently oil). These materials need ro be removed and properly disposed of. In addition to the <br />scrap piles, there is some remaining mining and ancillary equipment, but significantclean-up and <br />organization has been completed. <br />The water tank located on a bench above the RSRDA had been demolished, with only the foundation <br />remaining. <br />On the lower bench, wash plant demolition has been essentially completed with the exception of the shop <br />structure for which the operator projects possible future use. There was a section of intact concrete <br />retaining wall structure at the base of the slope behind [he wash plant shop and some intact concrete <br />
