III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations <br />made during the inspection. Comments in Section IV describe any enforcement actions <br />taken during the inspection and the facts or evidence supporting the enforcement action. <br />(iii) The consideration which has been given to making all of the proposed surface coal mining <br />and reclamation operations consistent with surface owner plans and programs; and <br />(b) The description shall be accompanied by a copy of the comments concerning the proposed <br />use by the legal or equitable owner of record of the surface of the proposed permit area and the <br />State and local government agencies which would have to initiate, implement, approve, or <br />authorize the proposed use of the land following reclamation. <br />(c) A map prepared to the standards of 2.10 shall accompany the plan. <br />(2) Underground mining activities. <br />(a) Each plan shall contain a detailed narrative of the proposed use following reclamation of the <br />land to be affected by all surface operations and facilities within the permit area. In accordance <br />with the land use categories established in the narrative, the plan shall include a discussion of the <br />utility and capacity of the reclaimed land to support a variety of uses and the relationship of the <br />proposed use to existing land use policies and plans. The description shall explain: <br />(i) How the proposed postmining land use is to be achieved and the necessary support activities <br />which may be needed to achieve the proposed land use; <br />(ii) Where a land use different from the premining land use is proposed, all materials needed <br />for approval of the alternative use under 4.16; and <br />(iii) The consideration which has been given to making all of the proposed surface mining <br />activities consistent with surface owner plans and applicable State and local land use plans and <br />programs. <br />(b) The description shall be accompanied by a copy of the comments concerning the proposed <br />use by the legal or equitable owner of record of the surface of the proposed permit area and the <br />State and local government agencies which would have to initiate, implement, approve, or <br />authorize the use of the land following reclamation. <br />(c) A map prepared to the standards of 2.10 shall accompany the plan. <br />(d) For those disturbed areas within the permit area where long term structures or facilities exist <br />or are to be constructed, the applicant may propose specific alternative land uses which may <br />be approved towards the end of the life of the mine through the permit revision procedures <br />required by 2.08.
