<br />III. COMMENTS-COMPLIANCE <br /> <br />Below are comments on the inspection. The comments include discussion of observations <br />made during the inspection. Comments in Section IV describe any enforcement actions <br />taken during the inspection and the facts or evidence supporting the enforcement action. <br />(h) "Fish and wildlife habitat' means land used wholly or partially in the production, protection or <br />management of species of fish or wildlife. <br />(i) "Developed water resources" means use of land for storing water for beneficial uses such as <br />stockponds, irrigation, fire protection, flood control, and water supply. <br />Q) "Undeveloped land" means land with no current use or level of management. It includes land <br />that has never been developed, or if previously developed, land that has been allowed to return <br />naturally to an undeveloped state or has been allowed to return to forest through natural <br />succession. <br />Rule 1.04(111) "Road" means a surface right-of-way for purposes of travel by land vehicles <br />used in coal exploration or surface coal mining and reclamation operations. A road consists <br />of the entire area within the right-of-way, including the roadbed, shoulders, parking and side <br />area, approach structures, ditches, surface, and such contiguous appendages as are <br />necessary for the total structure. The term does not include public roads, ramps, and routes of <br />travel within or adjacent to the immediate mining pit area or within spoil or coal mine waste <br />disposal areas. <br />(a) "Haul road" means any road used for the transportation of coal, spoil or coal mine waste. <br />(b) "Access road" means roads frequently traveled or used for purposes other than the <br />transportation of coal, spoil or coal mine waste, including, but not limited to, roads used for <br />supervision of mining operations, or servicing major facilities including sedimentation or <br />monitoring facilities, or other frequent uses. <br />(c) "Light-use road" means roads infrequently traveled or used on an intermittent basis for <br />purposes other than transportation of coal, spoil or coal mine waste, including, but not limited <br />to, roads used for monitoring, periodic maintenance of monitoring facilities, or other <br />occasional uses. <br />Rule 2.05.5 (1) Surface coal mining activities. <br />(a) Each plan shall contain a detailed narrative of the proposed use, following reclamation of the <br />land within the proposed permit area. In accordance with land use categories established in the <br />narrative, the plan shall include a discussion of the utility and capacity of the reclaimed land to <br />support a variety of alternative uses, and the relationship of the proposed use to existing land use <br />policies and plans. This description shall explain: <br />(i) How the proposed postmining land use is to be achieved and the necessary support activities <br />which may be needed to achieve the proposed land use; <br />(ii) Where a land use different from the premining land use is proposed, all materials needed for <br />approval of the alternative use under 4.16; <br />C-80-007, Page _7_ of _11 _ Pages, (date) _4 February 2002 (initials) _BGW <br />
