September 25, 2000 Basin Resources, Inc. 3800 County Road 63.9 Trinidad, CO 81082 Golden Eagle Mine, C-81-013 Citizen complaint follow-up inspection September 22, 2000 Participants: Ann Tatum, landowner Cazolyn Johnson, Citizens Coal Council (CCC) Carl Gerity, P. E., Pioneer Engineering Henry Austin, Office of Surface Mining (OSM) I conducted the above inspection on September 22, 2000, from 9:00 am to 2:30 pm at the Jim & Ann Tatum occupied residential dwelling know as Solitario. The inspection date and time was requested by Ms. Tatum in order for her consulting engineer, Mr. Gerity, to be present during the inspection. Ms. Johnson participated in the inspection representing the CCC. This partial follow-up inspection was required by an Interior Board of Land Appeals (IBLA) order dated July 26, 2000, which denied an OSM petition for reconsideration of the IBLA's January 5, 2000, decision regazding IBLA 96-90 and IBLA 96-91. These cases are two appeals of decisions made by the OSM Western Regional Coordinating Center (WRCC) Regional Director. The Tatum's filed the appeals with IBLA with respect to the WRCC Regional Director's decisions regarding the final disposition of citizen complaint No. CC-93-020-008. This inspection was required by the above IBLA decision to cite a violation of Colorado / DMG Rule 4.20.3(2) relating to subsidence damage to the above occupied residential dwelling. This was the only focus of the partial inspection. We began the inspection with a general discussion of the subsidence damage to the: home. Ms. Tatum primarily described the continuing cracking of the outside stucco finish, interior wall finish cracking /pealing /blistering, and signs of instability exhibited by what appc;azs to be displacement /movement between finished interior wall surfaces and ceiling vigas and flooring. We toured the inside of the dwelling as Ms. Tatum described the damage. Subsidence damage to the home was initially addressed by what Ms. Tatum chazacterized as cosmetic repairs (repairs) during ]996 and 1997. The damages described above and photographed during this; inspection have occurred since the repairs. Four damaged areas photographed were not evident to the inspection participants prior to the repairs, and will be noted later in this report. The only other potential subsidence damage described by participants, not related to the dwelling, is what appears to be a water saturated land surface in the pasture south of the residence driveway area and fence. Ms. Tatum indicated she believes the Trinidad City water line from Noith Lake to Trinidad traverses the pasture in this area.
