III. COMMENTS -COMPLIANCE <br />Below are comments on the Inspection. The comments include discussion.of observatlons made <br />during the inspection: Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. . <br />This was a complete inspection conducted by Joe Dudash of the Colorado DMG. No one represented the <br />operator during the field portion of this inspection. There was no snow at any of the sites. <br />Highway Temporary Coal Stockpile <br />In this azea, the coal stockpile had been removed and the area covered with soil and seeded. Additional soil <br />material was transported from the Bowie No. 2 Mine and placed on the west side of this site. The seeded azea is <br />greening up, except for the west side area where the additional soil material had been placed. There were no <br />erosional problems observed. The seeded hillslopes were stable. Straw bales aze in place along the railroad track ~~ <br />and at the inlet to the west side culvert. There was about Z feet of water iri the sediment pond. The pond drain <br />pipe was installed. The mine ID sign was up at the entrance. The road down to the site was passable. <br />Unit Train' Loadout <br />Other than a couple of workers in the shop, there was no activity on site. <br />The two east gates were open, while the west gate was closed. Mine ID signs were up at the entrances. The. <br />collection and diversion ditches had sufficient capacity. The collection and diversion culverts were cleaz. The <br />.sediment pond was dry and the primary and emergency spillways were functional. The pond's diversion ditch <br />and culverts were functional. <br />Run-of--Mine (ROMI Pile <br />The graveled haul road was in very good condition. The mine ID sign was up at the entrance. At the topsoil <br />stockpile, the topsoil sign was off of its post and should be put back up. Culverts and ditches were functional. <br />The well cap from one of the wells at the storage area is cracked and should be replaced. There was water to <br />within 1 foot of the primary discharge structure at the pond. The gated primary was closed. The pond <br />embankment was well vegetated. <br />Well Field <br />There was no activity at the site. The mine ID sign was up. The topsoil sign was off of its post and should be <br />reattached. The topsoil stockpile was well vegetated. <br />West Mine <br />The road to the West Mine fan area was in very good condition. The silt fence at the fan area will need a little <br />repair soon. The topsoil stockpile was well vegetated and the topsoil sign was up on its post. <br />The north end of the road from the fan bench to the reclaimed portal bench has a few erosional rills forming and <br />should be taken care of relatively soon. At the reclaimed bench azea, the lower pond had water to within 3 feet <br />of the primary discharge level. The gated valve was closed. The upper pond only had a little water in it. Both <br />pond embankments had sparse vegetation. Some of the silt fence azound this site will need repair soon. Two of <br />the boundary markets that designate, in the field, the upper area from the lower azea, were on the ground and <br />should be put back up. Backfilling is complete on the upper area while additional backfilling will be needed on <br />the lower area. <br />
