Pa e 3 <br />MINE ID # OR INSPECTOR'S <br />PROSPECTING ID #: x'1'2006-075 INSPECTION DATE: 11/092006 INITIALS: RMW <br />Review of the Division's policy on the Need for a Reclamation Perrnit, a copy of which is attached for your review, <br />indicates that, contrary to what the operator was told, it is the opinion of this inspector that reclamation permit <br />should have been obtained prior to engaging in mining activities. Therefore, the activities observed during this <br />inspection are noted as a possible violation ofC.R.S. 34-32.5-109(1) for failure to first obtain a reclamation permit <br />prior to engaging in a new mining operation. This issue is listed as a Possible Violation (PV) on page four of this <br />report. <br />The Division will schedule the PV item before the Mined Land Reclamation Board and, in addition, will send the <br />operator a Reason to Believe letter outlining the Board dates and times of the hearing. Since the operator has <br />already submitted an application for a Construction Materials 112 Reclamation Permit, the Division will recommend <br />to the Board that the operator receive approval for the permit by the current decision date of January 23, 2007. <br />Responses to this inspection report should be directed to Richard Wenzel at the Division of Reclamation, Mining <br />and Safety, Denver Office, 1313 Sherman Street, Room 215, Denver, Colorado 80203, phone number 303-866- <br />4935. <br />
