III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during the <br />inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br />evidence supporting the enforcement action. <br />On July 14, and 15 William J.Carter, Dan Hernandez, Byron Walker (Division of Minerals and Geology), Henry I <br />Austin (Office of Surface Mining), accompanied by Tom Anderson and Mark Milner, representing Oxbow Mininc <br />Inc., performed a complete inspection of the Sanborn Creek Mine.The weather was clear and hot during the <br />entire inspection. <br />Availabili(y of Records: <br />Records were found to be on site and in good order. See "DMG Availability of Records" form for more <br />information. <br />Signs and Markers: <br />• All "Mine and Permit Identification Signs" have been corrected, and new signs have been placed <br />where required. <br />• "Perimeter Markers" were found to be present and generally in good condition. Please continue <br />to repair markers damaged by the public. <br />• Proper "Blasting Signs" were found to be in all required locations. <br />R s: <br />All roads were found to be in good and stable condition. <br />Hy rologic Balance: <br />• Pond A is moist on the east end, but does not contain any free water at this time. <br />• Pond B is stable and contains about the same amount of water observed last month. <br />• Pond C is nearing completion, and is dry at this time. <br />• The east yard pond remains dry, and in good condition. <br />• The mine pond was discharging clear water during this inspection. <br />• The substation three pond was dry. This pond has been enlarged for the new vent shaft area and <br />appeazs to be in good and stable condition. The primary dischazge needs cleaning however, it <br />appears to be functional at this time. <br />• The sedimentation pond at the Upper Hubbard Creek site remains dry, and in good condition. <br />• All drain ditches are functional. Some locations require minor cleaning due to construction <br />contractors pushing rocks into the ditches, and some rock sliding off the slopes above the new <br />haul road. <br />• All sedimentation control actions requested in the last inspection have been completed. <br />• Upper Hubbard Creek seeps continue to show the changed locations. However, the outflow of <br />these seeps has reduced to a point where very little water is flowing through the culverts in <br />comparison to what had been noted in the last inspection report. <br />Backfill and Grading: <br />The Somerset mine portal has been plugged since 1986, but during the inspection it was being packed <br />with rocks and dirt before it is covered with the current construction. Tom Anderson took pictures at <br />this time for the record. <br /> <br />
