Pedestaled cottonwood trees were observed in the active pit area. <br />Mr. Bennett stated that the trees will be undisturbed, and the immediately <br />adjacent area backfilled and sloped to the base of trees during final <br />Reclamation. <br />9. The eastern pit perimeter (vertical wall) was encroaching upon the <br />San Miguel River. It is recommended that the pit maintain its current eastern <br />boundary such that the San Miguel River is not disturbed. Please commit to <br />such. Disturbance of the River may constitute a possible violation. The <br />eastern pitwall should be backfilled to attain the 3:1 slope specified in <br />Permit M-76-032. <br />10. The "Plant Area" contained a concrete batch plant, amongst other <br />facilities, equipment, and stockpiled materials. <br />A pit in the northeast sector of the "Plant Area" was created for containment <br />of byproducts resulting from washing cement trucks. The pit is excavated <br />occasionally. The byproducts are placed aside the pit, along the banks of the <br />San Miguel River; some material appeared to have washed into the river. This <br />constitutes a possible violation. The material is removed from that location <br />and crushed for use as salable material. Mr. Bennett stated the pit will be <br />enlarged such that stockpiled volumes next to the river will be reduced. <br />Please provide the Division with a plan for handling this material such that <br />concrete waste/leachate will not contaminate the river, i.e. an alternative <br />stockpile location, a berm downgrade of the current stockpile location, etc. <br />11. Mr. Bennett stated that an amendment will be submitted to the Division <br />addressing the plans to mine previously mined placer deposit stockpiles <br />northeast of the Plant Area. <br />The current permit document maintained by the division is unclear, and the <br />maps submitted to the Division in June, 1984 contradict the maps originally <br />provided with the Permit Application. <br />It would be beneficial to both Animas Aggregates and the Division if a <br />consolidated, clearly delineated permit were available. Perhaps the planned <br />amendment can clarify and depict the total affected land acreage (see <br />observation No. 3), mining and reclamation plans (see Nos. 4, 7, 10 & 11). <br />Please contact Camille Farrell indicating the expected amendment submittal <br />date. <br />CMF/srs <br />4379E <br />
