III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />This was a complete inspection conducted by Janet Binns of Colorado Division of Reclamation, <br />Mining and Safety. Mr. Henry Austin of the Office of Surface Mining and Enforcement, Denver Field <br />Office, accompanied the inspection for a complete oversight inspection. The mine is a reclaimed <br />surface mine, with no personnel on site. Mine records aze stored at the offices of Northwest Colorado <br />Consultants in Steamboat, Colorado. The weather was clear and windy. Mine site is dry. <br />Roads: The access road was in good condition to the facilities azea. The operator has been informed of <br />down cutting of the ditch along the west side of the mine access road near Pond D drainage. The <br />operator has indicated that this azea is scheduled for maintenance this summer. <br />Offsite Support Facilities: The access road to the loadout area remains in good condition. The loadout <br />pond was holding a pool of water, approximately 6" below the discharge pipe elevation. The pond was <br />quite moss choked. The pond embankment appeared intact and in good repair. Recent badger activity <br />was noted on the slopes of the irrigation ditch adjacent to the pond flume location. Burrowing was not <br />evident on the pond embankment. Well KW-3 still exists on the loadout site. A hole was evident in <br />the surface casing but no water was seen leaking from this well. Three power poles, powerline, and <br />one transformer remain on the loadout site. Vegetation on the loadout was in good condition. The <br />shop and warehouse building and the access road have been permitted to remain as permanent <br />structures. <br />Suonort Facilities: Facilities area pad and wazehouse building remain in good condition. Drainage off <br />the facilities azea pad is good with no sign of past ponding or erosion. Yard area is in good condition. <br />Shrubs planted along the NW portion of the facilities pad are experiencing roughly a 50% survival rate. <br />Hydrologic balance: None of the sediments ponds at the mine site, F, E, D, or A were dischazging, but <br />all held pools of water. Ponds A, B, D, and E have all been permitted to remain as permanent <br />structures. Ponds C and G have been reclaimed, and pond F is currently under review to remain as a <br />permanent structure (TR22). Pit 1 drainage, Ditch PD3, was in good shape and the operator has <br />discussed plans to armor the N W portion of this ditch just south of the county road. Pond <br />embankments and hydrologic control ditches appeared to be in good repair. <br />Slides and damaee: Areas previously withheld from bond release approvals due to gullying have <br />healed and have good vegetative cover established. <br />The slopes in Pit 1 looked good with no appazent gullying. Vegetation observed in the reclaimed pit <br />area looked good and vigorous. <br />Records: Records were checked on Tuesday, June 19, 2007. Since the mine and loadout are <br />reclaimed, no mine personnel remain on site. As such, the mine records are stored and maintained at <br />the offices of Northwest Colorado Consultants, in Steamboat Springs, CO. Mr. Bob Peterson is the <br />contact at the NWCC offices. Most of the records were contained in the file and updated regulazly. It <br />was noted that DRMS inspections from February 2007-May 2007 had not been updated.
