III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />This was an aerial inspection. that was flown on August 18, 2003. The digital images <br />were reviewed on August 25, 2003. There were no compliance problems that were <br />observed during the aerial overflight. <br />Roads <br />The main paved haul road was in good condition. The graveled haul road to the gob pile <br />was also in good condition. The access road that leads from the portal bench to the water <br />tank bench and the access road at the unit train loadout also appeazed to be in good <br />condition. <br />Topsoil Stockpile <br />There were no signs of erosional gullying at the mine site's main topsoil stockpile. The <br />collection and diversion ditches appeazed to be functional. The operator is placing <br />additional topsoil from the B-seam portal bench construction on to the stockpile. <br />There were no signs of gullying on the gob topsoil stockpile and on the coverfill topsoil <br />stockpile. The vegetative cover is starting to tum brown. <br />Hydrolo¢y <br />There was a moderate volume of water in Ponds B, C and D. Ponds J and K were dry. <br />Pond embankments appeazed to be geo-technically stable but the vegetative cover needs <br />to be improved for all of the ponds. <br />Gob Pile <br />The top of the gob pile appeazed to be dry. There were several small piles of gob placed <br />in the back of the main gob pile for drying. There were several small subsoil piles at the <br />front of the main gob pile for future covering of the lift outslope. The upland diversion <br />ditch and the west side collection ditch appeared to be functional. The road on the gob <br />pile appeared to be, in good shape. <br />Facilities <br />Construction work continues on the B-seam portal bench. The excavated subsoil and rock <br />material from the project is being placed into the. B-seam material storage azea. The west <br />side riprapped diversion ditch is in. The mine site haul road ditch serves as the east side <br />
