III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations <br />made during the inspection. Comments also describe any enforcement actions taken during <br />the inspection and the facts or evidence supporting the enforcement action. <br />This was a partial inspection conducted by Janet Binns of CDMG. The purpose of this inspection was <br />for a phase II bond release, SL03. Persons present during the inspection included; Don MacDonald <br />and Danny Kipp of Coors Energy Company, and Edith Savage of Savage and Savage environmental. <br />Topsoil: Topsoil replacement thickness was verified by digging holes with a soil auger on the pazcels <br />included in the bond release application. Topsoil depth was recorded at the point of color and texture <br />change. The spoil material contains significantly more clay than the sandy topsoil. Each topsoil hole <br />was photographed and photos are included with this report. The following topsoil replacement depths <br />were recorded. <br />Area 1: Topsoil hole No. 1= 24 inches. <br />Area 27: Topsoil hole No. 2=24 inches. <br />Area 26: Topsoil hole No. 3=22 inches. <br />Area 24: Topsoil hole No. 4=22 inches. <br />Area 21: Topsoil hole No. 5=24 inches. <br />Area 18: Topsoil hole No. 6=22 inches. <br />Area 8: Topsoil hole No. 7=21 inches. <br />CEC has committed to replacing 2 feet of "topsand" on the reclaimed azeas. The measured holes are <br />within acceptable variance to the 2 foot requirement. Consolidation of the topsoil material has <br />occurred since original lay down in 1995 and 1997. <br />Small area or areas that records of previously verified topsoil lay down were located did not have hole <br />dug during this inspection. These areas include areas 28, 14 and 3. A 0.5-acre area that had been <br />included in Area 24 did not have topsoil placement or perennial plant species present. It was agreed by <br />all parties that this 0.5-acre portion of parcel 24 would be removed from the bond release application. <br />The operator needs to submit a revised map with this area excluded from the application or revised text <br />to the bond release application clearly describing removal of this small parcel from the bond release <br />application. A rattlesnake was encountered in this 0.5-acre portion of area 24. <br />All bond release pazcels were visually inspected for vegetation cover and life form composition. <br />Parcels 1, 27, 26, 28, 24, 18 and 8 had healthy stands of predominately perennial grasses. The 0.5-acre <br />portion of azea 24 already noted above was dominated by annual species. Area 21 had received two <br />distinct soils. Half of this azea has established a healthy stand of mostly perennial grasses while the <br />other half with the sandier topsoil still exhibits a fair amount of annual species. Healthy perennial <br />species have established in the sandier area of this pazcel though the vegetation visually appears <br />different than the other half. The parcel still exhibits good cover. The southern portion of area 3 tends <br />towazd more annual species but perennial species are established as well. A healthy vegetative stand <br />dominated by perennial grasses has established as the inspection proceeded into the central and <br />northern portions of area 3. <br />
