III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the <br />inspection and the facts or evidence supporting the enforcement action. <br />This was a complete inspection conducted by Joe Dudash of Colorado <br />DMG. Dave Berry also represented the Division. The operator was <br />represented by Karl Koehler and Tavis Rogers. <br />Pond M3-N was discharging at a trickle. The discharge was clear. <br />The water level in the pond was just above the primary top. Pond <br />inslopes and outslopes were well grassed. Ditch inlets to the pond <br />were protected. The embankment appeared to be stable. The emergency <br />spillway and the weighted gate primary outlet were functional. <br />The water level in pond M3-S was up to the top of the primary. <br />There was no discharge out of the weighted gate primary. The area <br />around the primary outlet needs to be cleaned of sediment. The <br />embankment appeared to be stable. There were no problems observed <br />with erosion of pond inslopes or outslopes. <br />The one sump just south of Demonstration Area No. 3 was half full <br />of water. the other sumps were dry. <br />The rock filter near the outlet of culvert no. 4 needs a little <br />repair. The rock check dam at the outlet of culvert no. 2 needs a <br />new oil boom. The present one is starting to deteriorate. <br />DITCHEB AND CIILVERTB <br />The two county culverts just downstream of pond M3-N had a board <br />placed across the inlet openings. The culverts were functional but <br />could trap debris and eventually become a hazard. The board should <br />be removed. The outlets of culverts nos. 5 and 7 could use a little <br />cleaning, although they are still functional for now. The 24 inch <br />culvert just south of the large stock pond at the north end of the <br />mine site needs a little cleaning out at the outlet end, although <br />it is still functional at the present time. The other mine culverts <br />were completely clear. <br />A section of ditch F-2 is starting to downcut. This area will need <br />to be watched. Repairs may be needed in the future. One of the rock <br />check dams in ditch P-3 needs repair. Water is starting to go <br />around it. The center of the rock check dam should be lower than <br />1 <br />
