<br />Riverside Reservoir and Land Company <br />Riverside Irrigation District <br />Farmers State Bank of Brush <br />Case No. 90-CW-189 <br />Page 2 <br /> <br />voir & Irrigation Company, Jackson Lake Reservoir & ]Irrigation <br />Company, The Western Sugar Company, Central Colorado Water <br />Conservancy District and Ground Water Management Subdistrict of <br />the Central Colorado Water Conservancy District, City of Thorn- <br />ton, the Colorado Division of Wildlife, City of Brush, Lower <br />South Platte Water Conservancy District, City and County of <br />Denver, Division and State Engineers, and Farmers Reservoir and <br />Irrigation Company. No other statements of opposition were filed <br />herein and the time for filing such statements has now expired. <br />All of the Objectors have, either by stipulation filed with the <br />Court, or by signature of their counsel affixed hereto, have <br />consented to entry of this Decree. <br />4 . Overview: <br />The application seeks approval of an augmentation plan <br />whereby a junior surface water right described in Section B <br />below, will be diverted at Riverside Canal; the water so diverted <br />will be delivered through the Riverside Canal, may then be <br />temporarily stored in Riverside Reservoir and/or the proposed <br />wildcat Reservoir, and will be subsequently delivered and placed <br />into recharge ponds as described in Section C below, thereby <br />providing artificial recharge to the South Platte River; and 50~ <br />of the recharge credits so obtained will be used to augment out- <br />of-priority depletions by wells and/or gravel pits owned by Co- <br />applicant Farmers State Bank of Brush as described in Section D <br />below. The remaining 50~ of the said recharge credits will be <br />used by Co-applicants Riverside Reservoir and Land Company and <br />Riverside Irrigation District in future plans for augmentation or <br />substitute supply plans. No credit is claimed or awarded herein <br />for recharge which occurs during delivery of the subject water <br />rights from the headgate of the Riverside Canal to the Bruce <br />Weir; or during temporary storage of the subject water rights in <br />Riverside Reservoir or the proposed Wildcat Reservoir. Llothing <br />herein shall prevent Riverside from claiming such credit in a <br />future application. <br />B. APPLICATION FOR SURFACE WATER RIGHT <br />5.
