This schedule will set forth maximum monthly <br />pumping amounts for each well, depletion associated with the <br />gravel pits, previous monthly recharge, and will indicate the <br />resulting pattern of stream depletion. Under no circumstances <br />can the Bank and/or Riverside propose a depletion schedule which <br />results in a net negative stream depletion impact. <br />42. Honthly reports: <br />Riverside and the Bank shall submit monthly reF,orts to the <br />Water Commissioner, Water District No. 1, showing actual pumping <br />and stream depletion. Summaries of such reports shall be submit- <br />ted annually to the Division Engineer. Based on the actual <br />operation of the wells, Riverside and the Bank may propose a new <br />pumping schedule for each well as long as a net positive stream <br />depletion impact is indicated. Pumping by Riverside and the Bank <br />will always be limited by the amount of water previously re- <br />charged. An example of a monthly reporting form that may be used <br />to administer this Decree is attached hereto as Exhibit C. Any <br />monthly reporting form that is used in the administration of this <br />decree must be acceptable to the Division Engineer, and may be <br />amended from time to time with the approval of the iivision <br />Engineer without obtaining the separate approval of this Court. <br />43. Integrated system: <br />The surface water right, augmented structures, Recharge <br />Ponds, and the other structures involved in this recharge project <br />are parts of an integrated system. Accordingly, work on any one <br />project feature will be considered in finding that reasonable <br />diligence has been shown in the development of the other water <br />rights for all features of the project. <br />44. Retained jurisdiction: <br />In order to assure that the vested water rights of <br />others are not injured by implementation of this plan for augmen- <br />tation, the Court retains jurisdiction for a period of 10 years <br />after the date of this Decree. Upon proper petition filed with <br />the Court within that period, the Court will reconsider its <br />approval of the plan for augmentation. In the event Applicants <br />or any person, including the State Engineer, petitions the Court <br />for reconsideration on any of the elements of the plan, the Court <br />shall order appropriate notice to be given to all the parties <br />hereto. Such petition shall be verified, made in good faith, and <br />shall set forth with particularity the factual basis upon which <br />
