~ i <br />Ms Erica S Crosby <br />April 26, 1999 <br />Page 2 <br />The Report notes on Page 3 that there was no information in your files regarding groundwater <br />rights. Please find enclosed a copy of the Findings and Ruling of the Referee and Decree of the <br />Water Judge from District Court, Water Division No. 1, State of Colorado, Case Non. 90-CW- <br />189. The above referenced Decree should satisfy the augmentation questions. <br />With regard to Gravel Pit #4, the pit has been generally reclaimed, but we wish to continue the <br />mining and reclamation responsibility for the present time. Please find enclosed four pictures <br />of Pit #4 showing the reclamation. <br />With regard to Problems and Corrective Action: <br />1) We have placed a mining identification sign on site as required by Rule 3.1.12. <br />Please see enclosed two pictures of the sign that was placed at the entrance to the <br />property on April 16, 1999. <br />2) With regard to noxious weed species on site as identified during the visit, we <br />contacted Mr. Bruce Bosley, the Morgan County Extension Director/Agronomist, <br />took him to the site, and asked for a possible identification of the plants in <br />question for possible eradication. He noted the plant was Blazing Star and is not <br />noxious and is native to the area. Mr. Bosley indicated he will re-visit the site <br />during the growing season and if Knapweed is found he would visit with Bob <br />Samples and help him formulate an integrated Knapweed Management Plan. If <br />this occurs, we will forward a copy of the Plan for you. <br />Erica, we thank you very much for your kind assistance.
