`. - <br /> <br />soil that was covered were precisely followed. To the best of the inspector's knowledge, no <br />more soil was covered in the period between his visit and the visit of the inspector who <br />determined that a violation existed. <br />CC&V is perplexed by the issuance of a notice of a "possible violation" after at least three other <br />OMLR inspectors did not cite the instance as a possible violation. CC&V is concerned that the <br />OMLR action in this case could lead to a reduction in the amount of information shared by <br />CC&V about future voluntary corrective actions that are undertaken by CC&V for fear of a <br />single inspector's opinion that a violation may exist, which is then followed by excessive letter <br />writing and appearances before the Mined Land Reclamation Board. This is an OMLR action <br />CC&V believes is unwarranted because we (1) identified the problem, (2) corrected it, and (3) <br />took measures to prevent it in the future. <br />As you have noted in other contexts, CC&V has, to date, stockpiled in excess of 700,000 yd' <br />of soil materials, which is far more than we anticipated. Further, we have recovered all of the <br />soil that was covered as a result of this ready-line fill. The amount of soil involved in the <br />inspection report was about 125 yd'. Again, this material was saved the day the inspector <br />observed the covered material. <br />CC&V requests that the determination by staff that this was a "possible violation" be either <br />eliminated or changed to a "possible problem," which is what the issue was called in the <br />inspection report of October 11, 1994. Again, we responded to that report in our letter of <br />October 23, 1994, a copy of which is attached. <br />I hope this provides enough information to enable the OMLR staff to remove the possible <br />violation from the record.
