CC&V had, independent of the inspector's presence, determined that the soil had <br />been overridden and that it had to be removed. At the exact time the inspector was present, a <br />backhoe had just moved away to change a bucket and to then complete removal of the soil. <br />The measures we undertook were also listed in our letter to you of October 23, 1994. <br />There also has been a statement from OMLR inspectors that implied that CC&V had been <br />instructed to stop overriding soil and that CC&V had then continued to cover soil. That is <br />incorrect. CC&V had identified the problem area themselves and had voluntarily begun removal <br />prior to the time the inspectors had observed the problem. CC&V had completely halted <br />dumping of overburden in the area prior to the inspector's arrival and CC&V never resumed <br />dumping until after removal of all of the soil. Al] of the soil was trucked to permanent <br />stockpiles. The OMLR inspector's instructions to not cover any more soil and to remove the <br />
