Crane <br />Regional Director <br />Office of Surface t4ining <br />Reclamation and Enforcement <br />Brooks Towers <br />1020 17th Street <br />Denver, Colorado 80202 <br />Dear Mr. Crane: <br />By this letter, Energy Fue]s Corporation (EFC) requests, <br />pursuant to 30 C•F.R. 211, approval of a minor modification to <br />its presently approved federal mine plan for the Energy Fuels <br />1 and 2 Mines. <br />Specifically, EFC requests approval for the removal of <br />• topsoil from approximately 95 acres of land located immediately <br />adjacent to its existing mine plan area. The legal description <br />for those areas from which topsoil is proposed to be removed is <br />as. follows: <br />Toomship 4 North, Ranqe 87 West of <br />the 6th P.h1.; <br />Section 13 E. 1/2 S.E. 1/4 <br />Township 4 North, Ranqe 86 West of <br />the 6th P.b1.; <br />Section 18 S.W. 1/4; N.E. 1/4; S. 1/2 <br />Lot 6; S. 1/2 Lot 7; South 1/2 Lot 9; <br />Lots 9, 10, 11, 12; E. 1/2 Lot 14; and <br />N. 1/2 Lot 15. <br />The surface of these lands is owned by EFC. <br />The purpose for seeking approval for topsoil removal <br />on the described acreage is to prepare the surface of approx- <br />imately 10 acres for the construction of a sedimentation pond. <br />The proposed pond site is located docanslope and downstream from <br />ongoing mining activities within EFC's existing mine plan <br />boundaries. EFC has determined that its present system of <br />sedimentation structures will be inadequate to control runoff <br />frc:m its ongoing mining activities in accord with the effluent <br />limitations in applicable OSM regulations. The proposed sedi- <br />• mentation pond is intended to remedy this situation. we stress <br />
