III. COMMENTS -COMPLIANCE
Below are comments on the inspection. The comments include discussion of observations made
during the inspection. Comments also describe any enforcement actions taken during the inspection
and the facts or evidence supporting the enforcement action.
Two Notices of Violation (NOV s) were issued as a result ofthis inspection. Required abatement measures
and dates are as follows:
NOV CV-2002-018
1. By September 2Q, 2002, implement interim measures to safely direct all drainage from portal
bench/pazking area (including portal area seepage) into Sediment Pond 8.
2. By September 30, 2002, submit a complete technical revision application addressing appropriate
measures to modify, repair, or abandon and replace the existing buried PVC pipe drain system.
Design details including sizing, location, gradient and materials of all components of the proposed
system will need to be specified.
3. Implement and complete installation as specified in the technical revision plan, within 20 days of
final approval.
NOV CV-2002-019
1. By September 27, 2002, submit a technical revision application addressing:
a) Repair of borrow area gully, elimination of temporary road segment, and diversion of light use road
drainage away from the gully location into natural drainage.
b) Final reclamation map for RSRDA Borrow Area, and design for a stable drainage way into and across
the reclaimed RSRDA Borrow Area.
c) Plan for repairing eroded segment of backfilled Haul Road 2, and design for safely extending Haul
Road 5 drainage relief ditch to Coal Creek, without causing erosioin of reclaimed Haul Road 2 or
adjacent areas.
2. Implement and complete plans specified in technical revision within 20 days of final approval.
There are no outstanding abatement items from previous inspections.
