<br />(Page 31 <br />MINE ID # OR PROSPECTING ID # M"85"001 <br />INSPECTION DATE 17/9/95 Re~lsecl <br />INS CTOR'S INITIALS yytlE <br />Adjacent Excavation Approximately 0.25 mile west of the permit boundary DMG observed a <br />recent excavation located along the NW corner of the parking area for the American Electric <br />Company building, on property owned by Mr. Julian Gallegos. The excavation was approximately <br />50'L ~' 40'W with a 10' tall highwall which daylighted to the south. Exca ated material was <br />stockpiled immediately south of the excavation, total affected area was estimat d at <0.18 acres. <br />Evidence of excavated material leaving the site was not observed. <br />However, the excavation had cut into an elevated drainage ditch pad. Surface rainage, previously <br />contained within the ditch, may exit the ditch at the excavation. Drainage c ntrol structures for <br />the potential escaped ditch flow were not observed. Records indicate that MG has previously <br />responded to a complaint from Mr. Gallegos regarding property damages at or near the recent <br />excavation site, resulting from escaped ditch flow occurring during 8/93. <br />DMG contacted Mr. Gallegos at (970) 247-3134, to inquire about the nature~of the excavation. <br />Mr. Gallegos has agreed to provide details on the excavation activity, nec ssary for DMG to <br />recommend whether a reclamation permit is required. j <br />NOTE: During the January 2000 Board meeting the Board conditionally app oved Mr. Gallegos <br />request for declaratory order. The condition for approval was that Mr. Gall gos would not be <br />required to secure a reclamation permit at the referenced building site providing r.
