III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />This was a complete inspection of the Yoast Mine conducted on July 14, 2005 by Mike Boulay <br />of the DMG. The availability of records was checked at the mine site on July 15, 2005. Roy <br />Kazo of Seneca Coal Company was present during the entire inspection. It was hot and sunny <br />and ground conditions were dry throughout the mine site. Equipment operators were on mine <br />vacation so there was little activity at the site. The dragline was down and no coal was being <br />hauled from the site. <br />Availability of Records <br />All required records were on file and available for review at the mine office. Renewal of the <br />NPDES Permit is still pending review. SCC has received a Draft Renewal Permit for the Seneca <br />Mine complex. <br />Roads <br />Haul Roads A and B and the haul road into the active pit azea were dry and well maintained. <br />Water was not flowing in road ditches and road drainage ranouts along these sections of haul <br />road. The Light Use Road accessing the North pit was dry and in good condition. Culverts along <br />Haul Roads A and B were cleaz of sediment and debris and functioning properly. <br />Hydrologic Balance <br />Sedimentation Ponds 010, 011, O11A, 012, 013, and 014 were inspected. Ponds 011, O11A, 013, <br />and 014 were retaining significant amounts of water but not dischazging. Ponds 010 and 012 <br />were full and dischazging cleaz water. Pond inlets, embankments, and dischazge structures <br />appeaz stable and no problems were noted at any of the sediment pond locations. <br />The lower Armand Draw drainage was inspected. Five rock check dams in the drainage were <br />cleaned out prior to this inspection. The sediment that accumulated in the check dams was <br />removed and hauled to the regraded portion of the Neck Pit. This material will be blended into <br />the regraded azea and topsoiled and seeded. <br />Some minor erosion is occumng in portions of YPM-10 in the North pit. The liner is showing <br />through in several isolated stretches of the channel. Additional rock will be needed in these <br />locations. Two new gullies were noted in the upper end of the North pit. SCC indicated that <br />these aze scheduled to be repaired during this field season. <br />
