The principle <br />spillway culvert has been placed at the permitted discharge point. <br />The emergency spillway is under construction. "No discharge" <br />monitoring records are submitted as required. There has apparently <br />never been a discharge from the sediment pond. Monthly reporting is <br />required by the permit due to the ponds proximity to Hubbard Creek. <br />The mine plan Baas available for review at the mine office. <br />717.14 Backfillinq and Gradi <br />There has been no backfilling or grading at this mine. Road banks <br />and faceups cut during initial mine construction exist. Most likely <br />due to the nature of the soils, slumping is a recurring situation on <br />these cuts. These movements are presently limited to disturbed areas, <br />and have not moved into any watercourses. One slump are is immediately <br />above the man entry. Another area is tl~e road cut above the access <br />road to the pond. This causes recurring slumps in the roadside ditch. <br />Stabilization of these cuts will be difficult; the soil is loose and <br />rocky. The effectiveness of cutting back the slope is questionable. I <br />talked with Bill lJard, MSHA supervisor for the Delta, Colorado field <br />office, on July 31, 1980. He said that the Blue Ribbon Mine is due for <br />a quarterly MSHA inspection, and he would have his inspector evaluate <br />the safety of the slope above the man entry. If MSHA determines it to <br />be safe, OSM will direct the operator to reestablish the slumped diver- <br />sion channel above the portal. <br />717.17 Protection of the Hydrologic System <br />A contracted water truck fills at Huhbard Creek near the catch basin <br />for the coal stockpile. Straw bales line the creek edge for protection. <br />Several of the bales need replacement immediately. <br />
