III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />Hydrologic Balance <br />Sediment Ponds 005, 006, 016 and 016A were checked. Remaining sediment ponds (009, 017, and 015, could <br />not be accessed due to muddy conditions}. Water level in Pond 005 was approximately 5 feet below top of riser, <br />no discharge. Ponds 006, 016, and 016A were all discharging clear water over the top of the risers. The W24 <br />Series well reclamation project, below the toe of the 016A embankment was completed in August, and the well <br />area has been graded, topsoiled, and seeded. The French drain associated with the failed wells appeared to be <br />flowing at approximately the same rate as prior to reclamation, as anticipated. There does not appear to have <br />been any settling in the backfilled area. <br />Operator indicated that Stock Pond T-27, at the lower end of the reclaimed spoils in the 017 watershed has not <br />yet been constructed. Construction of this final stock pond will likely not be completed until the 2008 field <br />season. This location could not be accessed due to the fact that "K" road had been reclaimed, and travel over <br />the muddy surface of the reclaimetl route or the alternative steep two-track route was not possible. <br />Backfill and Gradin <br />It was evident that considerable rill and gully repair work had been completed in lower "A" Pit reclamation areas <br />recently, although the work was not closely inspected due to muddy conditions. Additional work is still <br />necessary to regrade/stabilize gullies on hillslopes immediately to the north of the oil well access road, <br />and in upper "A" Pit watersheds to the north and east of the aspen test plots area. <br />Operator indicated that all permanent channel construction and maintenance work in the South Mine area had <br />been completed, including riprap installation/repairs, and turf reinforcement mat installation. We observed the <br />junction of permanent channels PM-2 and PM-3, which had been re-configured in response to DRMS concern <br />that the prior configuration would be unstable. The revised confluence appears to be a more stable <br />configuration. Most of the reclaimed charnels in the South Mine area could not be accessed due to ground <br />conditions, and snow cover prevented detailed observation even in locations that could be accessed. <br />Operator reported that the lower end of Channel PM-4C in the vicinity of the road ditch junction, down to Culvert <br />PM-10, had recently been regraded, to improve the grade and eliminate the ponding noted on the most recent <br />aerial inspection. This location could not be accessed due to ground conditions. <br />SUDDOrt Facilities <br />The substation/repeater station location on the hill in the "C" Pit area, and associated access road from the <br />Ridgeline Road, had recently been regraded, topsoiled, and seeded. The remnant topsoil stockpile in this <br />location was used up by the project, and the topsoil stockpile footprint area was graded and seeded. Snow <br />cover prevented detailed observations. <br />The explosives powderhouse area near the shop had also recently been graded, topsoiled and seeded <br />TOpSOiI <br />Large scale topsoiling operations have been completed for the season. Topsoiling was completed on all <br />remaining graded spoil areas in the South Mine area. Topsoil stockpile foot print areas (where topsoil was used <br />up in the reclamation project) have been graded and seeded. Snow cover and muddy conditions prevented <br />detailed observations. Topsoiling yet to be done includes the "J" road berm areas previously discussed, as well <br />4 <br />
