III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. . <br />This was a complete inspection conducted by Joe Dudash of the Colorado DMG. Bill <br />Beaz represented the operator during the field inspection and the records check. The azea <br />received a precipitation event three days before. <br />Roads <br />The paved haul road was in very good condition, with the guard rail in place. The haul <br />road to the gob pile was in good condition. The road berm and ditch were functional. The <br />road from the portal bench to the water tank bench was in good condition with that road's <br />berm and ditch also functional. <br />Sins and-Markers <br />Mine ID signs were up and contained the correct information. Surface disturbance <br />mazkers were also up azound the mine site. Topsoil signs were also present. <br />Topsoil Stockpiles <br />The main topsoil stockpile at the mine site was very well vegetated. There were no signs <br />of erosional problems. Collection and diversion ditches were functional. There were no <br />problems observed at the gob pile topsoil stockpile and the coverfill topsoil stockpile. <br />Vegetative cover was moderate. At the train loadout topsoil stockpile, the vegetative <br />cover was poor to moderate. The diversion/collection berm was functional. Straw bales <br />were in place at the down gradient point. <br />Facilities <br />The operator is in the process of moving the longwall. The coal stockpiles were small to <br />moderate in size. No trains were being loaded during the inspection. There was no <br />evidence of fugitive dust problems during the inspection. <br />There were no problems at any of the facilities. There were no leaks at the fuel bam. A <br />contractor was constructing the conveyor overpass in advance of the B-seam portal bench <br />construction. <br />
