I found no evidence of massive impending <br />failure at the New Elk Mine. Although there are some conditions that could lead to future <br />problems, I understand that long-term-stability assessments--which would consider potential <br />effects--are not part of the evaluation agreement with the State. Both fills at the New Elk Mine <br />aze still being constructed, so the mine operator is addressing superficial instability as it occurs. <br />Because Ron has determined compliance with the specified inspection criteria, I conclude that, <br />for the New Elk Mine, the State has met the Oversight evaluation criteria as stated in the formal <br />Oversight Agreement. <br />If you like, you may pass this information on to DMG.
