Compliance :+i th Colors do Surface Coal lining Reclamation Act <br />CRS 1973, as amended 34-33-IO_', et. sec., <br />and the _~ <br />Rues and Reaula ti ons Issued 2srsuant ~ t`+e Acs <br />Tlis includes a listing of the particular provisions of the requ-'atorg program wh_c.4 were <br />examined during the course of this inspection, and identifies enforcement actions taken <br />during the inspection for failure to comply with the Rules and Regulations, the Act and <br />the permit. <br />4.02 Signs and Markers <br />As noted in the previous inspection, there are no perimeter markers around the <br />approved surface disturbance area at Red Canyon. Approval of the permanent program <br />application will allow additional areas of surface disturbance related to the k2 portal, <br />the refuse disposal area, and the sediment pond. When permit approval is granted, <br />perimeter markers will be installed. <br />9.05 Hydrologic Balance <br />All diversions, culverts and sediment control structures appeared well-maintained <br />and were in apparent compliance. Coal had been cleaned from the diversion ditch and the <br />culvert below the fuel tanks had been modified as requested in the previous inspection. <br />9.15 Re vegetation <br />The seeding done Iast fail below the haul road and in the area of the sediment <br />pond was not successful. Portions of the area, depending on the amount of additional <br />disturbance associated with construction of the new portal and yard area, will require <br />reseeding. <br />... ._, <br />
