The area has since been regarded and topsoil has <br />been replaced. Seeding will occur this spring. A small pond, less than 1 acre in size <br />was noted. There is no permit condition that limits the amount of exposed groundwater on <br />site (in fact most of the ponds will be reclaimed to groundwater exposed lakes). This <br />appears not to be an issue since the operator has an approved well permit and a temporary <br />substitute supply plan (TSSP) approved by the Office of the State Engineer (OSE). The <br />permit was recently renewed on December 23, 2005 and a copy was provided to the Division. <br />Area #5 Check 311t Pond area. Possibly 1 Pond Only- The mining plan identifies that <br />silt ponds will be used on site. Water is routed into one pond and then back into the pit <br />that is actively being wet mined with a dragline. It is a closed system, whereas water is <br />not discharged off site.
