III. COMMENTS -COMPLIANCE <br />Below are comments on the Inspection. The comments Include discussion.of observations made <br />during the inspection: Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />There were no erosional.problems at the topsoil stockpile. The topsoil sign needs to be put back up on <br />its post. Surface disturbance markers were present around the site. <br />Train Loadout <br />No railcars were on site during the inspection. Collection and diversion culverts and ditches all were <br />functional. The sediment pond was dry and the gated primary was closed. There were no signs of fuel <br />leaks at the fue] facility. The containment berm was functional. The straw bales at the top of the road <br />leading to the lower orchard need to be positioned better. The topsoil stockpile was erosionally stable <br />and had a topsoil sign. <br />Temporary Highway Coal Stockpile <br />There was no activity at this site. The sediment pond was dry. The mine ID sign was present. There <br />were no signs of erosional problems at this temporarily reclaimed site. <br />West Mine <br />The West Mine is starting to green up for the spring. There were some rills, no more than 3 inches <br />deep, at the site, mostly in the central part of the reclaimed site. A small gully was starting to form on <br />the road leading from the water tank area down to the reclaimed portal bench site. The silt fence <br />around the reclaimed site was functional, although some maintenance and repairs will be needed soon. <br />The upper sediment pond was wet but had no standing water. The lower pond had standing water to <br />within 8 inches of the primary. The lower pond gated valve was closed while the gated valve on the <br />upper pond was open, as designed. Both pond embankments had very little vegetative cover. There <br />was some brush debris at the inlet to the East Roatcap Creek culvert that probably should be removed. <br />Surface disturbance markers were up as was the mine ID sign. <br />Well Field <br />No problems were observed at the well field, except the topsoil stockpile sign needs to be put back up <br />on its post. The topsoil stockpile had a good vegetative cover. <br />Records <br />The records were in compliance, as noted on the attached records checklist. <br />c:/word bowie 1 /i nsp0304 <br />2 <br />
