`~ . <br />• (Page 2) <br />MINE ID # OR PROSPECTING ID # N(-)Q~{C-tCL^ <br />INSPECTION DATE_ ~I(0'OC <br />INSPECTOR'S INITIALS .~LS <br />This inspection was conducted primarily to secure data from the site allowing a re-evaluation <br />of the sufficiency of the financial warranty. The site was inactive at the time of the <br />inspection. Mr. Joe Baxter represented the operator, RBK Construction, during the inspection. <br />The ID sign for the site was in order. With the exception of the access/haul road, permit <br />area boundaries were marked by fences. All mining related disturbance associated with the <br />operation appeared to be within the permit area boundaries. <br />The site had indications of recent activity. A number of product stockpiles were in evidence <br />together with a screen. It is Division policy not to include removal of stockpiles of salable <br />material in the calculation of a financial warranty. <br />Most of the surface area for the pit, excluding the excavated portion, has been stripped of <br />topsoil which has been stockpiled near the western permit boundary. The stockpile is <br />irregularly shaped and covered with weeds but appears relatively stable. Measurements were <br />made of the stockpile footprint and average height. <br />As a result of the proximity of the Arkansas River and the high local water table, the <br />excavated area of the pit is filled with water. The company representative estimated the pit <br />to be perhaps 15 deep. The approved post mining land use for the site is wildlife habitat and <br />a permanent pond is part of the approved permit application. Most of the existing margins of <br />the water filled pit are currently too steep to meet the requirements of Rule 3.1.5 (7) for <br />permanent ponds which specifies slopes no steeper than 3:1 from 5 feet above to 10 feet below <br />the expected waterline and no steeper than 2:1 below that depth. Given the proximity of most <br />of the steep margins of the excavation to the permit area boundaries, it appears that to <br />bring the pit margins into compliance with Rule 3.1.5 (7) they must be backfilled rather than <br />pushed down. Measurements were made of the extent of the excavated area. <br />The access/haul road has been surfaced with asphalt which is not compatible with the post- <br />mining land use. Measurements were made of the length of this road in order to estimate the <br />cost of removing that surface. <br />Using the data gathered, a estimate of the cost of completing the approved reclamation plan <br />will be made by the Division. Should that re-evaluation indicate the currently posted <br />financial warranty is insufficient to complete reclamation of the site, the operator will be <br />so notified and given 60 days in which to bring the site into compliance.
