III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during the <br />inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br />evidence supporting the enforcement action. <br />This was a complete inspection conducted by Joe Dudash of the Colorado DMG. Basil Bear <br />represented the operator during the records check. No one represented the operator during the <br />field inspection. There was no activity at any of the mine locations. There was a light but steady <br />rain during most of the inspection. <br />West Mine <br />The snow cover was gone at the West Mine. The revegetation was not greening up yet. There <br />were no signs of erosional gullying, although there were some areas that had Tilling. There were <br />no signs of geo-technical slope instability on the reclaimed slopes. The upper sediment pond at <br />the West Mine was dry. The water level in the lower sediment pond was about 1.5 feet below <br />discharge. Both pond embankments were stable, as were the ponds' inslopes. The gated valves on <br />both ponds were closed. However, since the upper pond dischazge flows into the lower pond, the <br />gated primary valve on the upper pond should be open. The east collection ditch above and to the <br />west of the upper pend was faaetioeal. A eouple of t#te panels efsik €ence inJhat same area wiH <br />need maintenance soon. The two road culverts closest to the reclaimed entrance to the West Mine <br />will need cleaning soon, due to rock falls at the inlets to the culverts. For now, the culverts aze <br />functional but the rock falls will probably increase. The mine ID sign was up. <br />At the West Mine fan site, there were no signs of erosional problems. The topsoil stockpile was <br />greening up. The silt fence was functional, although a couple of panels will need maintenance <br />soon. The entrance road was in good condition. The operator's name on the mine ID sign needs to <br />be re-applied. The settling over the filled-in vent shaft has either slowed considerably or has <br />East Mine <br />The entrance gate was locked and the mine ID sign was up. The paved haul road was in good <br />condition, as were the other roads at the site. The operator had recently graded some of the roads <br />and maintained some of the ditches at the East Mine. The grader was still on site so more <br />maintenance work will be performed. There were no indications of slope instability with any of <br />the cut and fill slopes, including the highwall at the portal bench. <br />There was no water in any of the East Mine ponds, including Ponds Nos. I, 2, 3 and 4 and the <br />West Ridge waste pile pond. Pond bin walls and earthen embankments were stable and discharge <br />spillway structures were functional. Culverts and ditches around the site were in good condition, <br />although the road ditch segment just east of the surge bin on the warehouse level will need <br />cleaning soon. The straw bales surrounding the drop structure on the crusher/screener bench will <br />need replacing soon. <br />There were no new additions to the West Ridge waste pile. Collection and diversion ditches at the <br />waste pile and the upper diversion ditch at the reclaimed old waste pile were functional. <br />Vegetation was greening up at both sites. There were no signs of slope instability at either of the <br />waste piles. <br />
