:~ <br />• IPage 21 • <br />MINE ID M OR PROSPECTING ID k M-85-115 <br />INSPECTION DATE 2-17-99 INSPECTOR'S INITIALS SSS <br />OBSERVATIONS <br />This was a partial inspection of the Greer Pit, conducted as part of the Division's routine mine site monitoring program. <br />Conditions at the site were also noted, for recalculating the reclamation cos[ estimate, to determine if the existing financial <br />warranty is adequate to perform the required reclamation of this operation. <br />Mr. Greer indicated that the pit had been leased to a construction company last season. That company had hurriedly pulled <br />it's equipment out of the pit ,when bad weather came in last fall. In their haste, that company failed to regrade a portion <br />of the highwall to the 2:1 slope required by the permit. The operator indicated that the same company is due to move back <br />in to the pit in the next few weeks. Mr. Greer is cautioned not to let the operation fall out of compliance in the future. The <br />highwall grading will be required to be complete, to a 2:1 slope, by May 31, 1999. This allows ample time for the ground <br />to dry out, prior to the regrading. <br />Topsoil replacement had begun on portions of the pit slope where mining and final regrading have been complete. <br />However, the depth of the replaced topsoil was not measured. Mr. Greer is encouraged to seed completed slopes as soon <br />as possible, as long as the seeding takes place during the dates specified in the NRCS seeding recommendations, included <br />in the permit. <br />Mr. Greer indicated that the sediment control structure installed after the Division's previous inspection, caused some <br />erosion problems when an adjacent landowner allowed his irrigation ditch to overflow into the pit. The sediment control <br />berm blew out causing some downslope erosion. This appears to be a case where the sudden, large flow was more than <br />the berm was constructed to contain. However, the operator is encouraged to inspect this berm and ensure that it is <br />designed to adequately handle surface flows that are commonly experienced in the pit location. Erosional features from <br />the blowout need to be repaired and stabilized. <br />The reclamation cost estimate for this site was recalculated with updated cost figures (copy enclosedl• The recalculated <br />estimate indicates that the current financial warranty is inadequate to cover cost requirements associated with reclamation <br />of this site. Therefore, pursuant to Section 34-32.5-11714) of the Colorado Mined Land Reclamation Act, the Division <br />requires that J. Pat and Lila M. Greer submit adequate Financial Warranty within 60 days of receipt of this report and <br />reclamation cost estimate. Adequate financial warranty can be submitted by replacing the existing $5,000.00 financial <br />warranty with a new financial warranty in the amount of S5, 628.00 or by augmenting the current financial warranty with <br />a second financial warranty in the amount of 5628.00.
