It is our opinion that these issues must be addressed in a comprehensive manner to protect <br />human health and safety and the environment. We believe that a Federal Environmental <br />Impact Statement should be conducted for the Albert Frei & Sons Quarry in Clear Creek <br />Canyon. It is our understanding that the Albert Frei & Sons Quarry has requested that <br />Clear Creek County change zoning designation to expand the existing quarry operation by <br />144 percent. The cumulative impacts of all factors associated with this proposed <br />expansion, including the existing truck gravel truck traffic issues on U.S. 6 in Clear <br />Creek Canyon, must be evaluated now through a full Environmental Impact Statement, to <br />reduce additional loss of life and environmental degradation. <br />DMG Response: The operator has confirmed that all permitted acreage at the Walstrum Quarry <br />(125.9 acres) is private land. Any proposed expansion would also be located on private <br />land. Therefore, there is no statutory basis for the requirement of a Federal <br />Environmental Impact Statement (EIS). However, Section 34-32.5-115 (4)(d) of the Colorado <br />Land Reclamation Act for the Extraction of Construction Materials requires that the mining <br />operation, reclamation program, and future land use of the quarry comply with all laws <br />or regulations of the State of Colorado or the United States, including but not limited <br />to all federal, state, or local permits, licenses, and approvals, as applicable to the <br />quarry operation. It is the position and understanding of the Division of Minerals & <br />Geology that the operator is currently in compliance with the terms and requirements of <br />its mining and reclamation permit (Permit No. M-83-033) as well as the terms and <br />requirements of the Colorado Land Reclamation Act for the Extraction of Construction <br />Materials and the Construction Material Rules and Regulations of the Colorado Mined Land <br />Reclamation Board.
