During storm events, runoff from the mine flows <br />across U.S. 6 directly into Clear Creek. The Storm Water Discharge Permit required for <br />this mining facility does not appear to be enforced. <br />DMG Response: Mr. Frei indicated that the issue of truck staging, soil/mud carryout, and <br />back-up of truck traffic on the shoulder of U.S. 6 is being addressed. There was no <br />evidence of these concerns during the time of inspection. Mr. Frei indicated that the <br />practice of using a front-end loader to retrieve water from Clear Creek to wash U.S. 6 <br />is no longer being done. Mr. Frei also indicated that Albert Frei & Sons, Inc. is <br />coordinating with representatives of CDOT to design and install a 3 lane pull-out <br />immediately south of the quarry entrance and U.S 6. The 3 lane pull-out will greatly <br />minimize, if not eliminate, sedimentation on the highway and back-up of truck traffic. <br />The project is expected to be completed in April, 2002. This inspector also discussed <br />the operator's current stormwater management practices in the staging areas with Mr. Frei <br />and Mr. O'Brian. The Best Management Practices (BM P's) currently being used are straw <br />bales and silt fences. This inspector agreed to research available or known BMP's to <br />determine if there are more effective alternatives. Mr. Frei expressed an interest and <br />intent to use the best methods available to minimize sedimentation from truck traffic <br />leaving the quarry. A copy of this report and associated complaint letter is being sent <br />to the Water Quality Control Division. <br />5. DMRA Complaint: This area of Clearly Creek Canyon is prone to high winds that are common <br />during fall, winter, and spring. Residents of our community routinely observe dust clouds <br />from the mine. Mine dust can also be seen in large deposits on the ice covering Clear <br />Creek in winter, which is subsequently transported downstream in Clear Creek during melt- <br />off. The Air Quality Permit required for this mining facility does not appear to be <br />enforced. The covering of loaded trucks is not adequately enforced, resulting in <br />deposition of dust throughout the Canyon corridor to Golden. <br />DMG Response: Mr. Frei indicated that the quarry operation and its dust suppression system <br />is in compliance with the terms of the existing air quality permit issued by the Air <br />Quality Control Division. Mr. Frei also indicated that the existing permit is adequate <br />for production levels of 2 million tons/year and tht Al Frei & Sons, Inc. is currently <br />negotiating with representatives of the Health Department to increase production at the <br />quarry and still maintain adequate air quality standards. This inspector did not notice <br />any excessive fugutive dust at or near the quarry during the site inspection. This <br />inspector noticed during the inspection all loaded trucks leaving the quarry entrance to <br />stage in the parking area immediately south of the quarry entrance and Highway 6 and , <br />to apply a tarp or other suitable cover for dust suppression prior to exiting southbound <br />back onto Highway 6. A copy of this report and associated complaint letter is being sent <br />to the Air Pollution Control Division of the Colorado Department of Health. <br />6. DNII2A Complaint: The truck weight limits are not adequately enforced, resulting in spillage <br />of material on U.S. 6 throughout the Canyon. <br />DMG Response: This inspector did not see any evidence of spillage of aggregate or quarry <br />materials along U.S. 6 prior to or during the site inspection. Mr. Frei indicated that <br />weight limits are strictly enforced at the quarry/scale area as to help ensure that <br />truckers driving fully loaded trucks, leaving the Walstrum Quarry, are in compliance with <br />CDOT/Colorado State Highway requirements. <br />
